Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the InloveApp website at https://inloveapp.com, the InloveApp mobile applications when they are released, and all related features and services (together, the “Service”). InloveApp is a product and brand operated and provided by NGOBSUNLLC (“we”, “us” or “our”).

Please read these Terms carefully. They form a legally binding agreement between you and us. Our Privacy Policy, Privacy rights page and Refund and Cancellation Policy are incorporated into these Terms by reference.

By creating an account, accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. When you register we record the version of these documents you accepted. If you do not agree, you must not use the Service.

The Service is a relationship building and social-discovery platform intended for adults. You may only use the Service if you are at least 18 years old, or the age of majority in your country if that is higher, and are legally able to enter into a binding contract. We ask for your date of birth at registration and refuse accounts that do not meet this requirement.

You must register with accurate, current and complete information and keep it up to date. You may create only one personal account, and you may not create an account for anyone other than yourself. You may not use the Service if you have previously been removed from it or are prohibited from using it under applicable law.

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Do not share your password or let anyone else access your account. You can see and sign out of your active devices from your account settings. Notify us immediately through support if you believe your account has been accessed without your permission. We are not liable for loss arising from unauthorised use of your account that results from your failure to keep your credentials secure.

You agree to use the Service only for lawful purposes, in a respectful manner and in accordance with these Terms and our Community guidelines. You agree to treat other members with courtesy, to respect their privacy, and to comply with all laws that apply to you, including laws on data protection, harassment, intellectual property and online conduct.

You must not, and must not attempt to:

The Service allows you to publish profile information, photos, videos, messages, gifts and other material (“User Content”). You retain ownership of your User Content. By submitting User Content you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, display and distribute it solely for the purpose of operating, promoting and improving the Service, in accordance with your settings. This licence ends when you delete the content or your account is closed, except where the content has been shared with others who have not deleted it, or where we retain it as described in section 8 or in our Privacy Policy.

You are solely responsible for your User Content. You confirm that you own or have the necessary rights to it, that it is accurate where it concerns you, and that it does not breach section 5. We do not endorse any User Content and are not responsible for it.

The Service includes profile discovery, likes and matches, private messaging, virtual gifts, voice and video calling where available, and group features. Profiles are recommended by rules we can explain, not by a learned model. Interactions with other members are at your own risk. We do not carry out criminal background checks on members and we do not verify the identity, statements or intentions of any member. A “verified” badge means only that a member of our team matched a selfie taken in a pose we chose against the profile photos; it is not identity verification. Always use caution when communicating with or meeting other members, never send money to someone you have met through the Service, and report any concerning behaviour through the in-app reporting tools.

Messages are not end-to-end encrypted. Trained staff may read a specific conversation when investigating a report, subject to the controls described in our Privacy Policy.

We may, but are not obliged to, review, moderate, remove or refuse any User Content at any time and without notice. Automated rules may flag content or hold a message for review; decisions to suspend or ban an account are made by a person, and you can appeal a moderation decision from your account. We may investigate suspected breaches of these Terms and take any action we consider appropriate, including issuing warnings, removing content, restricting features, suspending or terminating accounts, and reporting unlawful activity to law enforcement. Our decisions on moderation and enforcement are made at our reasonable discretion.

Content you remove, and content we remove, may be retained for a period so that reports about it can still be investigated and so that we can meet legal obligations, as described in our Privacy Policy.

Some features of the Service are free and others are paid. Paid features currently comprise:

The features included in each subscription, the credit cost of each gift and boost, and the exact prices are shown in the Service before you buy, and prevail over the summary above if they differ. Prices are set in US dollars. Payments are processed by Paddle, which acts as the merchant of record for your purchase, may present the price in your local currency at checkout, and is responsible for charging and remitting any applicable sales tax, VAT or similar charges, which are shown before you confirm. We do not receive or store your card details.

The Service also shows advertising from us about our own features to members without an ad-free subscription. Where we offer credits for watching a rewarded advertisement, those credits are granted free of charge and the daily number is limited.

A subscription renews automatically at the end of each billing period at the then-current price until you cancel. You can cancel at any time from the Premium section of your account. By default cancellation takes effect at the end of the current billing period and you keep the paid features until then. You may instead choose to end the subscription immediately, in which case the paid features stop at once and the remainder of the period is not refunded except where the law requires otherwise.

If you change to a different plan, the change takes effect at the start of your next billing period; we do not charge or credit part-periods. Only one pending change can exist at a time, and a new request replaces it.

Prices may change. Any change to the price of a recurring subscription will be communicated to you in advance and will apply only from the next billing period after the notice, so that you have the opportunity to cancel first. Promotional or introductory prices, where offered, apply for the period stated in the offer, after which the standard price applies.

Credits are an in-Service currency. They can be purchased, and may be granted free of charge, for example for watching a rewarded advertisement. Credits are a limited, personal, revocable, non-transferable licence to use certain features of the Service. They have no monetary value, are not currency or property, cannot be exchanged for cash or transferred to other members or accounts, and may not be sold or traded outside the Service. Credits granted free of charge have no cash value and are never refundable.

Credits spent on a gift or a boost are consumed at that moment and the feature is delivered immediately: a gift is shown to the recipient and is not converted into credits for them, and a boost runs for its stated duration. Unused purchased credits remain on your balance while your account remains active and in good standing. We may change the price of credits or the number of credits a feature requires, but such changes will not reduce the credits already on your balance.

Refunds for subscriptions, credits and other purchases are handled in accordance with our Refund and Cancellation Policy, which forms part of these Terms. Nothing in these Terms limits any statutory right to a refund or to withdraw from a purchase that you have as a consumer under the laws of your country of residence.

We may suspend, restrict or terminate your access to the Service, with or without notice, if we reasonably believe that you have breached these Terms, that your conduct may harm other members, us or third parties, that your account is being used fraudulently or in an unauthorised way, or where we are required to do so by law. If we terminate your account for a breach of these Terms, you will not be entitled to a refund of any unused subscription period or credits, except where the law requires otherwise. We may also discontinue or modify the Service, or any part of it, at any time; where we discontinue a paid feature that you have paid for in advance, we will provide a proportionate refund or an equivalent alternative.

You may close your account at any time by asking us through support. Closing your account does not by itself cancel a subscription; cancel it first from the Premium section, or tell us in the same request and we will cancel it for you. Our Privacy rights page explains what happens to your information when an account is closed.

On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination, including sections 6, 11, 12 and 14 to 18, will continue to apply.

The Service, including its software, design, text, graphics, logos, trademarks, and all content other than User Content, is owned by us or our licensors and is protected by copyright, trademark and other intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose in accordance with these Terms. You may not copy, modify, distribute, sell, lease, reverse engineer or create derivative works from any part of the Service, or use our name, logo or trademarks, without our prior written permission.

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties or representations, express or implied, about the Service, including any warranty that it will be uninterrupted, error-free, secure or free of viruses, that any defect will be corrected, or that it will meet your requirements. We make no warranty as to the accuracy, conduct or compatibility of any member, or that you will find a match or achieve any particular result. Content provided by other members reflects their views, not ours.

To the fullest extent permitted by law, we and our directors, employees, agents and suppliers will not be liable to you for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or opportunity, arising out of or in connection with the Service or these Terms, however caused. To the fullest extent permitted by law, our total aggregate liability to you for all claims arising out of or in connection with the Service or these Terms will not exceed the greater of the amount you paid to us for the Service in the twelve months before the event giving rise to the claim and one hundred US dollars (USD 100).

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by applicable law. If you are a consumer, nothing in these Terms affects your statutory rights.

To the extent permitted by law, you agree to indemnify and hold us harmless from any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of your User Content, your use of the Service, or your breach of these Terms or of any law or third-party right.

These Terms are governed by the laws of the country in which NGOBSUNLLC is established, without regard to conflict-of-law rules. If you are a consumer, you also benefit from any mandatory provisions of the law of the country in which you reside, and you may bring proceedings in the courts of that country. We encourage you to contact us through support first so that we can try to resolve any dispute informally.

We are continually improving the Service and may add, change or remove features at any time. We may also update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the Service with a new “Last updated” date and, where appropriate, by notifying you within the Service or by email. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of them. If you do not agree to the updated Terms, you must stop using the Service and may close your account.

These Terms, together with the documents incorporated into them, constitute the entire agreement between you and us regarding the Service. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign or transfer these Terms; we may assign them to a successor or affiliate that operates the Service.
